In a landmark ruling delivered on Friday, a full panel of Namibian High Court Judges declared the common law crimes of sodomy and “unnatural sexual offences” unconstitutional and invalid.
The conclusion was reached by High Court justices Nate Ndauendapo, Shafimana Ueitele, and Claudia Claasen.
The ruling followed an application by Friedel Dausab, a gay Namibian man, who sought to have the criminalisation of male anal sex and “unnatural sexual offences” declared unconstitutional.
