Court orders sale of nurse’s car in Kanyama lawsuit

A Toyota Fortuner owned by a nurse, Mathilde Kadhikwa from northern Namibia is scheduled to be sold on auction on 21 November in Tsumeb.

This follows a Windhoek High Court ruling requiring Kadhikwa to cover the legal costs of Shapwa Tangeni Kanyama and his wife, Beata.

Judge Beatrix de Jager recently ordered Kadhikwa to cover the Kanyamas’ wasted legal costs on the scale of one instructing and one instructed legal practitioner, leading to the attachment of her assets.

The Toyota Fortuner, one of the attached assets, will be held in storage until the auction.

“In terms of the inventory, the Deputy Sheriff has attached a Toyota Fortuner to be sold in execution,” read the notice.

“We now proceeded to arrange for a sale in execution scheduled to take place in Tsumeb on 21 November 2024,” with plans for publication in Republikein and The Namibian on November 8, 2024,” read the notice.

The defamation lawsuit, filed by Kanyama and his wife, seeks N$400 000 in damages, alleging that Kadhikwa’s remarks on social media were aimed at damaging their reputation.

The court action was prompted by comments made by Kadhikwa on May 30, 2022, just days after the Kanyamas’ wedding ceremony at Oniipa, which was reported to have cost N$10 million.

The couple claims the comments defamed them, with the statements insinuating financial misconduct, corruption, and dishonest business practices.

According to the Kanyamas, the remarks, although not directly naming them, included specific details closely associated with their lives, such as Kanyama’s involvement in pharmaceutical procurement, the couple’s luxury wedding, and their prominent home featuring a cinema, wine cellar, and gym.

They argue that these statements were intended to paint Kanyama as a corrupt businessman engaged in criminal activities, which also implied that Beata married a dishonest individual.

Kadhikwa, who has decided to defend herself against these claims, is being represented by Henry Shimutwikeni through Legal Aid.
